Who are Cyber Criminals? What are the Indian and Global perspectives on cybercrimes?

15 marks

Answer

Cyber Criminals are individuals or organized groups who utilize computer technology, networks, and the internet to perform illegal activities. These actors range from lone hackers and disgruntled employees to sophisticated state-sponsored groups and transnational criminal syndicates. Their primary motivations include financial gain through theft or extortion, political activism (hacktivism), espionage, or the intent to cause disruption and damage to critical infrastructure.

The Indian perspective on cybercrime is primarily governed by the Information Technology Act, 2000, which was amended in 2008 to address emerging threats like identity theft, cyberstalking, and data breaches. India faces unique challenges due to its rapid digitalization, a large population of first-time internet users, and the rise of financial fraud. The government has established the Indian Cyber Crime Coordination Centre (I4C) and the CERT-In (Computer Emergency Response Team) to centralize incident reporting, threat intelligence, and law enforcement coordination across state and national levels.

The Global perspective views cybercrime as a borderless threat that undermines international security and economic stability. Because cyberattacks can originate in one jurisdiction and impact victims in another, global cooperation is essential. Key frameworks include the Budapest Convention on Cybercrime, which serves as the primary international treaty for harmonizing national laws and facilitating cross-border evidence collection. Organizations like INTERPOL and UNODC play critical roles in fostering collaboration between nations to track transnational syndicates, share intelligence, and standardize legal responses to digital warfare and organized cyber-criminal activities.

List and explain the classification of various cybercrimes? Give examples.

15 marks

Answer

Cybercrimes are broadly classified based on the target of the attack and the nature of the criminal activity. The primary classifications are as follows:

  1. Crimes against Individuals: These involve targeting specific persons to harass, stalk, or defraud them. Examples include cyberstalking, where an individual is repeatedly harassed via email or social media, and online defamation.
  2. Crimes against Property: These crimes involve the theft or destruction of digital assets. Examples include computer vandalism (destroying data), intellectual property theft (copyright infringement), and the transmission of malicious software like viruses or worms to damage systems.
  3. Crimes against Government/Organizations: These are often politically or ideologically motivated and target critical infrastructure or sensitive data. Examples include cyber-terrorism, where hackers attack power grids or government databases, and cyber-warfare involving state-sponsored espionage.
  4. Financial Crimes: These are motivated by monetary gain and involve manipulating digital financial systems. Examples include credit card fraud, phishing attacks to steal banking credentials, and ransomware, where data is encrypted until a payment is made.
  5. Crimes against Society: These involve activities that harm the public order or morality. Examples include the distribution of illegal content, such as child pornography, trafficking in illegal goods via the dark web, and inciting violence or hatred through online platforms.

These classifications help law enforcement agencies and security professionals categorize threats, determine the severity of the offense, and develop appropriate countermeasures to mitigate risks.
