Explain why the International Organization, Agencies and Treaties were established?

8 marks

Answer

International organizations, agencies, and treaties were established to harmonize intellectual property (IP) laws across borders, ensuring that creators and inventors receive consistent protection regardless of where their work is exploited. The primary objectives include:

  • Standardization: To provide a uniform framework for IP rights, reducing legal uncertainty and transaction costs for businesses operating internationally.
  • Enforcement: To facilitate cross-border enforcement mechanisms, allowing rights holders to protect their assets against infringement in foreign jurisdictions.
  • Economic Growth: To promote innovation and creativity by ensuring that inventors can monetize their work globally, which encourages investment in research and development.
  • Dispute Resolution: To provide structured platforms for resolving conflicts between nations or entities regarding IP rights, such as the World Intellectual Property Organization (WIPO) and the World Trade Organization (WTO) under the TRIPS agreement.
  • Technology Transfer: To create a balanced system that encourages the transfer of technology and knowledge from developed to developing nations while respecting the rights of the original creators.

Explain with an example why Intellectual Properties need to be protected.

7 marks

Answer

Intellectual property protection is essential to incentivize innovation, ensure fair competition, and prevent the unauthorized exploitation of creative effort. Without legal protection, the incentive to invest time and capital into new ideas is diminished because competitors could easily replicate the work without incurring the original development costs.

For example, consider a pharmaceutical company that spends billions of dollars and over a decade on research and clinical trials to develop a life-saving drug. If there were no patent protection, generic manufacturers could immediately copy the chemical formula and sell the drug at a fraction of the price, as they would not have to recover the massive R&D investment. This would lead to a market failure where the original innovator cannot recoup their costs, ultimately discouraging the company from pursuing future medical breakthroughs. By granting a patent, the law provides a temporary monopoly, allowing the company to recover its investment and profit, which in turn fuels further innovation and societal progress.
