What are the objectives of Drugs and Cosmetics Act 1940? Give the subsequent modifications that are made to the Act?

5 marks

Answer

The primary objectives of the Drugs and Cosmetics Act, 1940 are to ensure that drugs and cosmetics sold in India are safe, effective, and conform to prescribed standards of quality. It aims to regulate the import, manufacture, distribution, and sale of drugs and cosmetics to prevent the use of substandard, adulterated, or misbranded products. Additionally, it seeks to promote the rational use of drugs and protect public health by establishing regulatory authorities and quality control laboratories.

Subsequent modifications to the Act include the Drugs and Cosmetics (Amendment) Act, 1964, which expanded the scope to include Ayurvedic and Unani drugs. The 1982 Amendment introduced stringent penalties for the manufacture and sale of adulterated or spurious drugs, including life imprisonment. Further amendments, such as the 2008 Amendment, focused on enhancing the powers of inspectors, streamlining licensing procedures, and establishing the Central Drugs Standard Control Organization (CDSCO) as the central regulatory body.

b

What classes of drugs are prohibited for import? Explain the procedure for import of drugs meant for different purposes.

9 marks

Answer

Under the Drugs and Cosmetics Act, the following classes of drugs are prohibited from import: misbranded drugs, adulterated drugs, spurious drugs, drugs not of standard quality, drugs claiming to cure diseases specified in Schedule J, and drugs whose manufacture, sale, or distribution is prohibited in the country of origin. Furthermore, any drug that does not comply with the labeling and packaging requirements prescribed under the Act is prohibited.

The procedure for the import of drugs is as follows:

  1. Import License: Any person intending to import drugs must obtain a license in Form 10 or 10A from the Licensing Authority, upon application in Form 8 or 8A.
  2. Registration: Foreign manufacturers must register their products with the Central Drugs Standard Control Organization (CDSCO) before applying for an import license.
  3. Customs Clearance: At the port of entry, the importer must present the import license, bill of entry, and relevant documents to the Assistant Drug Controller.
  4. Sampling and Testing: The Drug Inspector may draw samples for testing at the Central Drugs Laboratory (CDL) if there is suspicion regarding the quality of the consignment.
  5. Special Purposes: Drugs imported for personal use, clinical trials, or examination/analysis are subject to specific exemptions and require special permits (e.g., Form 12A for examination or test) rather than a full commercial import license.
