8 marks

Answer

Under Section 3 of the Mines Act, 1952, the Act does not apply to certain excavations if specific conditions are met. These exemptions generally apply to the extraction of minerals for non-commercial purposes or small-scale operations. The conditions are as follows:

  1. The excavation is for the purpose of prospecting for or extracting minerals to be used for building purposes in residential buildings or for the construction of roads or other civil works, provided the excavation is not for commercial sale.
  2. The depth of the excavation measured from its highest to its lowest point does not exceed 6 meters.
  3. The number of persons employed in the excavation does not exceed 50 at any one time.
  4. No explosives are used in connection with the excavation.
  5. The excavation does not extend below the superjacent ground level.

If any of these conditions are violated, the excavation is deemed a mine and falls under the purview of the Mines Act, 1952.

  2. Form and Manner: The notice must be sent in the prescribed form and manner, providing details of the nature of the accident, the number of persons killed or injured, and the circumstances surrounding the event.
  3. Fatal Accidents: In the event of a fatal accident, the place of the accident must not be disturbed or altered for a period of 72 hours, unless such action is necessary for the safety of other persons or for the recovery of bodies, or if the Inspector gives permission.
  4. Reporting of 'Dangerous Occurrences': Certain occurrences, such as fires, explosions, or spontaneous heating, which may not result in injury but pose a significant risk, must also be reported to the authorities as specified in the rules.
