15 marks

Answer

The development of mine safety legislation in India has evolved through several critical milestones, transitioning from unregulated mining practices to a comprehensive regulatory framework focused on worker safety and health.

  1. The Mines Act, 1901: This was the first formal legislation in India to regulate mining operations. It introduced the concept of a Chief Inspector of Mines and established basic safety standards, though it was relatively limited in scope.
  2. The Mines Act, 1923: Replacing the 1901 Act, this legislation significantly expanded the powers of inspectors, introduced stricter provisions for mine management, and mandated the maintenance of accurate mine plans.
  3. The Mines Act, 1952: This remains the foundational legislation for Indian mining. It was enacted post-independence to consolidate and amend the law relating to the regulation of labor and safety in mines. It introduced comprehensive provisions regarding hours of work, leave with wages, and stringent safety measures.
  4. The Mines (Amendment) Act, 1959: This amendment introduced critical changes, including the requirement for the appointment of competent managers and safety officers, and provided for the constitution of the Mining Board and Committees.
  5. The Mines (Amendment) Act, 1983: This amendment was a major overhaul, introducing provisions for the participation of workers in safety management through Workers' Representatives and Safety Committees. It also increased penalties for non-compliance and strengthened the role of the Directorate General of Mines Safety (DGMS).
  6. The Mines (Amendment) Act, 2003: This amendment further modernized the legal framework, focusing on the health of persons employed in mines, including provisions for medical examinations and the prevention of occupational diseases.
  7. Recent Regulatory Developments: Ongoing updates to the Coal Mines Regulations (2017) and Metalliferous Mines Regulations (1961) continue to incorporate modern technology, risk assessment protocols, and digital monitoring to address contemporary mining hazards.

These milestones reflect a shift from basic oversight to a proactive, risk-based safety management system that emphasizes both technical compliance and the active involvement of stakeholders in maintaining safe working environments.

Answer

Under the Mines Rules, 1955, the appointment and functions of a Welfare Officer are mandated to ensure the health, safety, and welfare of mine workers. The provisions are structured as follows:

Appointment: The owner, agent, or manager of a mine where 500 or more persons are ordinarily employed must appoint at least one Welfare Officer. If the number of persons exceeds 2,000, an additional Welfare Officer must be appointed for every 2,000 persons or part thereof. The appointment must be notified to the Chief Inspector and the Regional Inspector.

Qualifications: A Welfare Officer must possess a degree of a university recognized by the State Government, a degree or diploma in social sciences from a recognized institution, and adequate knowledge of the language spoken by the majority of the persons employed in the mine.

Duties: The duties of a Welfare Officer include:

  • Establishing and maintaining contact between the management and the workers to promote harmonious relations.
  • Advising the management on the provision of welfare amenities such as canteens, shelters, rest rooms, and drinking water.
  • Ensuring compliance with the provisions of the Mines Act and Rules regarding the health and safety of workers.
  • Assisting in the formation of works committees and other joint committees.
  • Encouraging the formation of cooperative societies and sports or cultural activities for workers.
  • Bringing to the notice of the management any grievances of the workers and suggesting remedial measures.

Conditions of Service: The Welfare Officer holds a status equivalent to that of a senior officer in the mine. Their service conditions, including pay, allowances, and other benefits, must be fixed by the management and approved by the Chief Inspector. The management cannot dismiss or demote a Welfare Officer without the prior concurrence of the Chief Inspector, ensuring they can perform their duties impartially without fear of victimization.
